CARMUNITY — TERMS OF USE

These Terms of Use ("Terms") govern your access to and use of the Carmunity mobile application, website and related services (collectively, the "Carmunity Service", "Carmunity", "App", "we", "us" or "our").

Carmunity is a platform designed to connect drivers, car enthusiasts, clubs, event organisers and automotive businesses through features including route planning, navigation, live drive tracking, clubs, events, social content, garages, points of interest, marketplace services and other automotive community features.

By creating an account, accessing or using Carmunity, you agree to these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use Carmunity.

2. Eligibility

You must be at least 16 years old to create a Carmunity account.

If you are under 18, you confirm that you have permission from a parent or legal guardian to use Carmunity where such permission is required.

You must hold a valid driving licence and comply with all applicable laws if you use Carmunity while driving a motor vehicle.

You must not use Carmunity if you are legally prohibited from doing so.

3. Your Carmunity Account

Some Carmunity features require you to create an account.

You agree to:

  • provide accurate and current information;
  • keep your login details secure;
  • not share your account credentials with another person;
  • notify us if you believe your account has been accessed without permission; and
  • take responsibility for activity carried out through your account.

You must not impersonate another person, organisation, club or business.

We may suspend or terminate accounts which contain false information, impersonate others, breach these Terms or are being used unlawfully.

4. Driving and Road Safety

Carmunity is intended to assist drivers. It is not a substitute for safe, responsible and lawful driving.

You are solely responsible for the safe operation of your vehicle.

When using Carmunity you must:

  • obey the Highway Code and applicable road traffic laws;
  • obey road signs, speed limits, restrictions and instructions from police or other authorities;
  • never interact with the App where doing so would distract you from driving;
  • only use a mobile device while driving where permitted by law;
  • use a suitable hands-free or vehicle-mounted system where appropriate; and
  • always use your own judgement when following a route or navigation instruction.

Road signs, road conditions and official instructions always take priority over information shown by Carmunity.

Where Carmunity provides information relating to speed limits, safety cameras, hazards, road conditions or other driving information, such information may be incomplete, inaccurate, delayed or out of date.

Carmunity does not guarantee the presence, absence, position or accuracy of any speed camera, speed limit, road hazard or other road information.

You remain responsible for complying with the law at all times.

5. Routes and Navigation

Carmunity may allow users to create, discover, share and navigate driving routes.

Routes may be generated by Carmunity, third-party mapping providers or other Carmunity users.

We do not guarantee that a route is:

  • safe;
  • legally accessible;
  • suitable for your vehicle;
  • free from road closures;
  • suitable for prevailing weather or road conditions;
  • accurately mapped; or
  • available at the time you choose to drive it.

A route appearing within Carmunity does not mean that we have inspected, approved or verified that route.

You should assess road conditions yourself and change or abandon a route whenever necessary.

6. Live Tracking and Convoy Features

Carmunity may provide location-sharing and live convoy features which allow participating users to see the approximate location of other users.

By activating a live tracking feature, you understand that your location may be visible to other authorised participants for the period during which the feature is active.

You should only share your location with people or groups you are comfortable sharing it with.

Location information can be delayed or inaccurate because of GPS accuracy, mobile coverage, device settings, battery restrictions or other technical factors.

Live tracking must never be relied upon as an emergency, rescue, security or personal-safety service.

7. Clubs

Carmunity allows users to create, administer and join automotive clubs and communities.

Unless expressly stated otherwise, clubs hosted on Carmunity are independently operated by their respective owners or administrators.

Carmunity does not control or accept responsibility for:

  • decisions made by club administrators;
  • club membership;
  • club rules;
  • club-organised activities;
  • statements made by club members;
  • events or drives organised by clubs; or
  • disputes between members or administrators.

Club administrators are responsible for ensuring that their activities and use of member information comply with applicable laws.

We reserve the right to remove or restrict any club that breaches these Terms or creates a risk to Carmunity or its users.

8. Events, Meets and Group Drives

Users, clubs and businesses may create or promote events, meets, drives and other activities through Carmunity.

Unless Carmunity is specifically identified as the organiser, Carmunity is not the organiser of these activities.

Attendance is at your own risk.

Event organisers are responsible for obtaining any necessary permissions, licences, insurance, risk assessments and approvals.

Carmunity does not guarantee the quality, legality, safety, availability or accuracy of an event advertised through the App.

9. Points of Interest

Users may submit or discover locations including viewpoints, meeting locations, photography locations and other points of interest ("POIs").

A POI appearing in Carmunity does not mean that Carmunity has verified that the location is publicly accessible, safe or legally accessible.

You must:

  • respect private property;
  • obey parking restrictions;
  • comply with access restrictions;
  • avoid trespassing; and
  • behave responsibly at all locations.

10. User Content and Drivagram

Carmunity allows users to upload or publish content which may include photographs, vehicle information, posts, comments, messages, routes, POIs, event information and other materials ("User Content").

You retain ownership of your User Content.

By uploading User Content to Carmunity, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and distribute that content as necessary to operate, promote and improve Carmunity.

You confirm that you have the necessary rights to upload the content.

You must not upload content that:

  • is unlawful;
  • is threatening or abusive;
  • constitutes harassment or bullying;
  • promotes dangerous or illegal driving;
  • encourages street racing or other illegal activity;
  • infringes intellectual property rights;
  • contains malicious software;
  • contains another person's private information without permission;
  • is fraudulent or misleading;
  • contains unlawful discriminatory or hateful content;
  • is sexually explicit or otherwise inappropriate for the Carmunity community; or
  • breaches applicable law.

We may remove content or restrict accounts where we reasonably believe these Terms have been breached.

11. Vehicle Garage and Registration Information

Carmunity may allow users to create profiles for their vehicles and upload vehicle photographs, specifications and other information, including MOT, service and insurance dates.

You are responsible for deciding what vehicle information you make publicly available.

MOT, service and insurance dates you enter may be used to send you reminders and, in the future, push notifications recommending garages, insurers and other automotive companies.

We recommend that users consider the privacy implications before publicly displaying information such as vehicle registration numbers, regular parking locations or other information that could identify the location of a vehicle.

12. Messaging and Communications

Carmunity may provide direct, group and club messaging.

You must not use Carmunity messaging to:

  • harass users;
  • send spam;
  • conduct fraud;
  • distribute malicious links;
  • make threats;
  • send unlawful marketing communications; or
  • conduct illegal activity.

We may investigate reported messages or content where necessary to enforce these Terms, protect users or comply with legal obligations.

13. Marketplace

Carmunity may provide a marketplace containing products, services, businesses, affiliate links, member offers and advertisements.

Unless explicitly stated otherwise, Carmunity is not the seller of third-party products or services displayed within the Marketplace.

Any contract to purchase third-party products or services is between you and the relevant seller or provider.

We do not guarantee the quality, suitability, availability, legality or accuracy of third-party products, services or offers.

Carmunity may receive commission, affiliate revenue or other compensation when users purchase products or services through certain links.

Sponsored or promoted content may also appear within Carmunity.

14. Free and Paid Memberships

Carmunity may provide different membership levels, including free and paid subscriptions.

The features included within each membership level will be displayed before purchase and may change from time to time.

Paid plans may include subscriptions such as Drive Plus and Pro Driver, together with monthly, 6-month, 12-month or other subscription periods offered within the App.

Prices are displayed before purchase.

15. Subscriptions and Automatic Renewal

Where subscriptions are purchased through the Apple App Store or Google Play, payment is processed by the relevant platform.

Unless otherwise stated when purchasing, subscriptions automatically renew at the end of the applicable subscription period unless cancelled before renewal in accordance with the rules of the relevant app store.

You can manage or cancel your subscription through your Apple App Store or Google Play account.

Deleting the Carmunity App does not automatically cancel an active subscription.

Deleting your Carmunity account may also not automatically cancel an App Store or Google Play subscription. You should separately cancel the subscription through the platform through which you purchased it.

Prices and subscription options may change. Any applicable changes will be communicated in accordance with applicable law and the rules of the relevant app store.

Your statutory consumer rights are not affected.

16. Free Trials and Promotional Offers

We may offer free trials, introductory prices, promotional subscriptions or other offers.

Eligibility and duration may vary.

Unless stated otherwise, a trial subscription may convert into a paid subscription at the end of the trial period unless cancelled before the applicable renewal deadline.

The price and renewal terms will be shown before you confirm the subscription.

17. Intellectual Property

The Carmunity name, logo, software, interface, graphics, designs, databases and other content created by or for Carmunity are owned by or licensed to us and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, reverse engineer or commercially exploit Carmunity or its content without our written permission, except where applicable law expressly permits it.

18. Third-Party Services

Carmunity relies on third-party services which may include mapping, navigation, hosting, analytics, notifications, payment processing, safety information and other technologies.

Those services may have their own terms and privacy policies.

We are not responsible for the availability or performance of services outside our reasonable control.

19. Availability of Carmunity

We aim to provide a reliable service but cannot guarantee that Carmunity will always be available, uninterrupted, secure or error-free.

Features may occasionally be unavailable because of:

  • maintenance;
  • software updates;
  • network problems;
  • GPS availability;
  • third-party service outages;
  • mobile coverage;
  • circumstances outside our control; or
  • changes required for legal, technical or commercial reasons.

We may add, change or discontinue features from time to time.

20. Prohibited Use

You must not use Carmunity to:

  • organise or encourage illegal street racing;
  • promote dangerous driving;
  • evade law enforcement;
  • harass or threaten another person;
  • commit fraud;
  • distribute malware;
  • scrape or harvest user information without permission;
  • interfere with the operation or security of Carmunity;
  • create fraudulent accounts;
  • misuse another person's location information; or
  • conduct any other unlawful activity.

21. Suspension and Termination

We may suspend, restrict or terminate your access to Carmunity if we reasonably believe:

  • you have breached these Terms;
  • your activity poses a risk to another user;
  • your account is being used fraudulently;
  • your use creates security or technical risks; or
  • suspension is required by law.

Where appropriate and reasonably practicable, we will provide notice.

You may stop using Carmunity at any time and may request deletion of your account through the functionality provided within the App or by contacting us.

22. Disclaimer and Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to applicable law, Carmunity does not accept responsibility for loss or damage arising solely because a user relied upon:

  • inaccurate navigation information;
  • user-created routes;
  • POI information;
  • speed camera information;
  • speed limit information;
  • live location information;
  • content supplied by another user;
  • club activities;
  • third-party events; or
  • third-party marketplace products or services.

Nothing in these Terms affects your statutory rights as a consumer.

23. Changes to These Terms

We may update these Terms when Carmunity, our business, applicable law or regulatory requirements change.

Where a change materially affects your rights, we will take reasonable steps to notify you.

The latest version will always be available through Carmunity and/or our website.

24. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom or another jurisdiction, you may also benefit from mandatory consumer protections applicable where you live.
